On 12/28/2023, lawyers for Adam Montgomery want the body-cam footage of Adam's interaction with the police just after they started their search for his daughter, Harmony Montgomery.
This encounter with the police happened on 12/31/2021, where he spoke with police just as they had started their search for his missing daughter.
A judge had already suppressed some statements, but now Adam's lawyers want the entire interaction barred; saying that Adam Montgomery was exercising his rights, and that the encounter could be seen as prejudicial.
But the Attorney General's office is arguing that Adam Montgomery's living condition and demeanor are highly relevant.
"The context and the purpose of that meeting was not to see if he would talk to them", legal analyst Patricia LaFrance, of Black, LaFrance & Ballinger (who isn't involved with the case) said. "The purpose, as they stated in their police reports and the objection, was to try to locate Harmony Montgomery".
Adam Montgomery is scheduled to go to trial for 2nd Degree Murder in February, 2024.
