Vermonters: Live Next To a River? Where's Your Permit?



On 3/21/2024, the Vermont Senate had a 3rd reading of and passed bill S.213, which will require Vermonters who live next to riverways and wetlands to get a permit for any building projects. 

This bill requires Vermonters who live in a "river corridor" - which includes the river itself and the surrounding land - to obtain a State Permit in order to build anything on their own land. If the bill is signed by Governor Phil Scott  - or overcomes his veto - this permitting process will begin in 2028.

According to this legislation, this bill directs the State to guarantee that there is a net-increase of wetlands/river-corridors in Vermont over time. It would attempt to accomplish this by requiring Vermonters who damage more than 5,000 square feet of wetlands during their development to restore twice as much wetlands.

"As Vermont continues to rebuild and recover from the devestating floods of 2023, we must do everything in our power to rebuild smarter and stronger with resilience against future flooding events at the forefront", said Senate President Pro-Tempore Phil Baruth (D/P - Chittenden Central)

The flooding of 2023, according to Baruth's damage report release, had damaged over 4,000 homes and 800 businesses, and had caused more than $200,000,000 in damage to Vermont's public infrastructure.

Governor Phil Scot is in opposition to this bill because, "This bill would put Vermonters in jeopardy of violating laws that they don't even know exist".

This bill comes with a near-$5 Million price tag.
